This morning I woke up to an interesting story from the one other state in the US that has legalized and protected porn production – New Hampshire. No that story has nothing to do with condoms and porn, but it does have to do with the fundamental issue behind condoms in porn. Freedom and right to choose personal risks.

In Dover, New Hampshire, a school board member wants to ban high school football in the town. Dr. Paul Butler, a retired surgeon, notes that the possibility of a concussion on a developing brain is devastating. He is also a former high school and college football player so it isn’t as though he doesn’t understand what happens on a football field. And it is not as though there aren’t medical studies to support his claim ( Please see: ).

This follows last month’s Board of Health decision in New York City to ban the sale soft drinks larger then 16 ounces. Mayor Bloomberg championed the measure and stated that he thought “This is the single biggest step any city, I think, has ever taken to curb obesity, it’s certainly not the last step that lots of cities are going to take, and we believe that it will help save lives” ( Please see: )

In Calabasas, California the city government has not only banned smoking in bars and restaurants but in 2006 they extended that ban to ALL public places. And then in 2008 they further extended the ban to include the balconies of your own apartment. If someone decides to light up on their balcony – they get evicted ( Please see: ).

In 2011, San Francisco banned toys from McDonald’s Happy Meals ( Please see: ). Hazelwood, Missouri banned Girl Scouts from selling cookies on their own front lawn ( Please see: ). And in Midway, Georgia the police busted three little girl’s lemonade stand for not having a business license ( Please see: ).

What does all of this have to do with Ballot Measure B and condoms in porn ? Everything…

This is what the United States has turned into… “The Land of Fees and the Home of the Safe.” Long gone are the free and the brave.

I am appalled at how many people and elected officials are willing to trade personal freedoms for safety. We have diverged so far from the principles that this nation was founded upon that we have certainly lost our way. Benjamin Franklin must be doing cartwheels in his grave. His words should be etched into collective consciousness of every American;

“They who can give up essential liberty to obtain a little temporary safety, deserve neither liberty nor safety.”

Rebecca Bardoux is a 20-year veteran of the adult film industry. She first stepped in front of the cameras in 1992, during the last of the ‘golden years’ of porn, and has appeared in 200 adult feature movies. Michael Fattorosi: My Meeting with Rep. Howard Berman and Asm. Bob Blumenfield

Sometimes as an attorney I get to do interesting things, well at least interesting to me. Before porn, I was involved in politics in my home state of New Jersey as well in Washington D.C. during college. I ran for elected-office as well as ran campaigns for other politicians and worked with former New Jersey Governor James McGreevey before heading off to law school ( Please see: ).

On October 8th, I was invited to a private “meet and greet” with Congressman Howard Berman and Assemblyman Bob Blumenfield (photo on right) ( Please see: and ). Berman is running for re-election against another sitting Congressman, Brad Sherman, due to redistricting in the San Fernando Valley. Both are running for election in the 30th Congressional District and both are democrats ( Please see:,_2012 ). The new “30th Congressional District” contains most of the San Fernando Valley.

Assemblyman Bob Blumenfield is the sitting democratic in the 40th Assembly district however his district has also been redrawn and is now the 45th Assembly District which also contains most of the San Fernando Valley. His opponent is Republican Chris Kolski ( Please see: ).

For all intents and purposes, Congressman Berman (photo below) and Assemblyman Blumenfield are the industry’s representatives in Congress and the California State Assembly.

October 8th was also the day that the Republican Party and the Libertarian Party both took positions against Ballot Measure B. However, the Democratic Party as yet to make a decision as to Ballot Measure B. Neither Berman or Blumenfield have yet to take an official position on Ballot Measure B though both represent most of the businesses and the talent of the adult entertainment industry located in the San Fernando Valley.

At the meet and greet, I was able to have in-depth conversations with both Berman and Blumenfield as well as their staffers. All understood the impact that Ballot Measure B would have on the industry and the lives of their constituents. Everyone was well aware of the potential loss of business and tax revenue for the San Fernando Valley that Ballot Measure B could inflict if passed.

What was more interesting was their positions as to whether worker safety laws should be the subject of a county wide ballot measure. Prior to being elected to Congress, Howard Berman was an attorney that specialized in Labor and Workers Compensation law. He understood the complexity of establishing safety laws in a workplace. As a state Assemblyman, Blumenfield was also well versed on worker safety issues.

I should probably also note at this point, that Los Angeles City Councilman Mitch Englander was the ONLY City Council Member to vote against the Los Angeles City “Safer Sex in Adult Film Ordinance” that now requires condoms in adult films in the city of Los Angeles ( Please see: and ). Councilman Englander, who also represents the San Fernando Valley, was the only Council Member with the political and personal fortitude to stand up and protect his constituents’ interests.

As an industry we need to reach out to our representatives, local, state and national. We are a legal industry. We are an industry that is under attack and we need the support those that we elect. Whether it is “Condoms in Porn” or even the Stop Online Piracy Act, which Berman was a co-sponsor of, the industry needs to have their seat at the political round-table ( Please see: ). Without question the Valley’s largest employer is the adult entertainment industry. Employing an estimated 5,000-10,000 people annually there is no larger single employer. Between family and friends of those in adult, it can be estimated that there are 15,000 to 45,000 voters in the San Fernando Valley that have some connection to the industry. It is time that the people in adult entertainment be recognized as voting block. Blumenfield won his last election by 20,000 votes. Howard Berman won his last election by 60,000 votes. And is currently trailing Brad Sherman, his opponent, in the polls 45% to 32%. And Mitch Englander won his seat on the City Council with little more than a 6,200 vote victory gap.

And on November 6th get out and vote against Ballot Measure B !

In Remembrance of Fallen Heroes on 9/11

On September 11, 2001, the United States of America changed forever. Let us never forget the 2,977 that lost their lives that day or the families they left behind. Let us never forget the sacrifice made by those first responders, the NYPD, NYFD, Paramedics and regular citizens, who rose to the occasion and saved as many as they did.

I grew up in the shadow of the Twin Towers. On a clear day you I could see them from the hill in my hometown in New Jersey. I had friends that worked in the Towers. Luckily no one that I knew died. Others where not as fortunate as I. Please take a moment of silence in your own heart for those that didn’t make it out and remember how fortunate we all are.

Of UFC Fighters, Comedians, Poetry & Porn…

Last night Vanessa and I had the distinct pleasure of being able to spend some time over a dinner with a group of interesting and varied people. We were in Las Vegas and were able to catch Bryan Callen’s comedy show at the Paris Hotel. Afterwards, he invited us to join him, a writer and another comedian and two UFC fighters for dinner. It is always interesting being the “porn people” in a group of mainstream people. Usually, we are inundated with questions about the industry. Last night was no different, however it does give me/us a chance to ask some questions of them as well. It is always a learning experience.

Of course the Mr. Marcus and syphilis topic did come up. However, interestingly only two of the mainstream people were even aware of the situation – one of the UFC fighters and the writer. Which I suppose means that our dirty laundry so to speak hasn’t penetrated the mainstream news as far I as previously believed. However, this subject led us to a more important discussion – testing.

Performers have often compared themselves to athletes and even UFC fighters as far as their job description is involved and how performers are akin to those who fight and exchange bodily fluids in close “hand to hand,” so to speak, proximity. When I told the UFC fighters that as a practice the industry does NOT require full panel testing they were somewhat surprised since they indicated that they have to under go full panel testing as a fighter and could not imagine stepping into the Octagon without both parties being fully testing for all potential diseases that could be passed. They basically indicated they simply would not fight someone unless they were completely tested.

Then the issue of MRSA was raised. If you are unfamiliar with MRSA, that is basically a staph infection that enters the body through the exchange of bodily fluids such as mere sweat through a break in the skin, cut or abrasion. The staph bacteria is quite deadly if it enters one’s blood and difficult to treat with antibiotics. It plagues not only UFC fighters but also porn performers and any other sport where there is body to body contact. We often refer to MRSA or staph infections as a “spider bite.” Apparently there is a special spider that only lives in Chatsworth, California that specifically targets performers and always seems to bite on their victim’s ass region. We do not talk about MRSA that much in the adult industry but it is certainly a topic for discussion on its own. I have personally know numerous performers that contracted it, with one even requiring hospitalization to treat it.

We then moved on from syphilis, testing and MRSA to racism. One of the fighters asked if it were true that some of the women in the industry charged more to perform with a black man than a white one. They were shocked by the answer. Both fighters could not fathom the idea of asking for a higher fight fee because he was fighting someone of a particular race. This notion was so foreign to them it appeared we as an industry were still operating in the dark ages, no pun intended. While they noted there is some racism in the UFC, they for the most part, treat each other like family.

They had to admit that while they are fierce and combative in the Octagon and during practice, for the most part they all have an extreme amount of respect for themselves, each other and the UFC. I got the impression that the both of them truly loved what they did and felt blessed to be apart of it. They are what we used to be – a family. They cared so much for each other they had to admit it was difficult to watch their friend’s fights.

I also got that impression from the comedians and writers in the group. The writer, who has written several movies and TV series, said that whenever he has a chance he always try to write parts into his projects for his friends. The main characters are always cast by the production company but for the lesser parts he has the ability to cast and clearly write for. The other comedian in the group indicated that she has opened up numerous times for Bryan through-out his career. Knowing other comedians I can say that is true amongst most of them. If you ever watch a comedy movie you will always see several comedians in the same movie. Once one comic makes it he/she tries to take his/her friends with them.

To a large extent, that is how the adult industry use to be. A small group of people that knew each other, cared for each other and helped each other when we could. They might not have always liked one another but they stood together. Whether it was against governmental intrusion or attack from the mainstream. I have only been in adult for 8 years and I only caught the tail-end of that period. Vanessa who has been in adult for 16 years remembers it well. It was a much different industry then.

Porn has turned from mom & pop producers to “big international business” with much of the control of the Los Angeles based industry  coming from outside the United States. We are no longer a local industry but instead a part of a global movement. A movement that wants to vertically integrate all aspects of porn, from talent to production to distribution, including hosting, traffic, bandwith and advertising. A one stop shop that some might call a monopoly. Los Angeles may become nothing more than a cog in the wheel of a much larger global “porn” machine.

Perhaps Mr. Marcus’s decision to alter his test was more then just a lesson in paper vs. database or APHSS vs. TTS. Perhaps it was a lesson in what the future holds for porn in the United States. I guess the time has come when people have to decide for themselves which road they want to go down. Jessica Drake probably said it best when she blamed greed as the cause of this situation. It is easy to choose a fast money over long money. It is more difficult to choose money over health. If the those in the industry do not respect themselves, their co-workers and their health there simply will not be an industry in Los Angeles to work in. The hardest decision is to chose family over personal financial interests. I suggest the road not taken…
